Any order implies agreement to the present general terms of sale. The sale contract submits to Swiss law.
1) Offer for sale :
The offer for sale of our products is valid in Switzerland and in the countries of European Community and is subject to stock availability.
Although we take great care in describing and presenting the articles sold as precisely as possible, some errors might occur. In this case, we cannot in any way be considered responsible.
The photographs showing the articles have an indicative value only due to changes which may occur during transcription onto the site.
Due to our purveyors, we may be obliged to deliver an item whose manufacture may be slightly different from the one described, but will always be in keeping with our quality requirements.
2) Prices :
Our prices are shown in Swiss francs (VAT included) and in Euros (export duty free value).
They are guaranteed except in the case of a typographical or printing error.
E-pointbreak.com reserves itself the right to change the prices anytime. We reserve the right to pass on any change in VAT. The valid price is the one in force on the ordering day.
Prices do not include post and packing. (according to the price in force).
Invoices should be kept with any article returned for an exchange or a refund.
3) Orders :
If you wish to place an order on line, a quick and easy selection of our collection is provided.
If you do not wish to place an order on line, you may do so :

- By e-mail info@pointbreak.ch. Please do not forget to complete all the necessary details on the order form
- By fax : ++41 22 300 15 33. You may fax your order 24 hours a day. Please do not forget to complete all the necessary details on the order form.
4) Acceptance of the offer and confirmation of the order by e-pointbreak.com :
The contract is concluded when the customer issues confirmation of his/her order.
e-pointbreak.com sends an e-mail confirming your order within 3 working days (except for orders coming on Friday, Saturday, Sunday and off days) and giving details wether the item is immediately available and its delivery date.
You may also print out your order.
The contract is confirmed when the customer issues its order confirmation.
5) How to pay :
If you order on line and pay with a credit card, you have to refer to Datatrans terms of sales from.
If you order by phone, e-mail or fax, you have to pay the due sum within 8 opening days. Past this delay, the item may be offered again for sale.

The order will be send only after receipt of the payment.
Do not forget to indicate your customer number (if you have one), your name and address.
6) Delivery :
All items in stock will be dispatched by post to the address you will have provided including a fixed-price participation to making and posting the package. (depending on the order amount) within the delay mentioned in E-pointbreak.com confirmation (cf point 3) except under force-major case.
7) Exchange and returns
If the item has a fault, if it does not correspond to your order or if it is not the right size (only for clothes), you may return it to be replaced by the adequate item.
If you need to return or exchange an item for any reason, you have to contact Point Break (see point 3)) within 5 days to ask for a return number. No return or exchange will be accepted without this number.
If a return is authorized, please send the package with the unworn goods in the original packaging enclosed a copy of the bill to the following address:

Exclusively in case of item default or if it does not correspond to your order, sending and return charges are our charge. A size exchange for a clothe is your charge.
8) Aftersales :
Blackhawk items are life guaranteed. In case of default, they will be repaired or exchanged.
US Armor wraps are 18 month guaranteed, US Armor packages are 5 years guaranteed, both from making date. In case of bullet impact, the will be freely exchanged, if the damaged item is presented with a police or an official organ report.
9 ) Data Protection Act :
We need to know your personal details in order to deal with any request you may make.
If you give us your e-mail address, we will be able to send you confirmation of your order as well as information on our special offers.
In compliance with Data Protection Act from 19 June 1992 you have the right of access to and modification, rectification and removal of personal data. If you wish to exercise this right, either write to :(POINT BREAK, PO Box 1164, CH-1227 Carouge) giving your surname, first names, address and if possible your customer number or request it through e-mail on our site.
POINT BREAK reserves the right to collect information about the user, particularly by the use of cookies.
10) Intellectual property :
All elements of the e-pointbreak.com site, be it visual or sound, including any subjacent technology, are protected by copyright, trademarks or patents. They are exclusively POINT BREAK property.
Any user who has a personal Internet site is able to put on his site a simple link which gives direct access to the POINT BREAK site homepage. This will in no way imply an affiliation contract.
On the other hand, any hypertext link using the framing technique or in-line linking to establish connection to POINT BREAK is strictly forbidden.
In any case, any link, even tacitly authorised, must be removed at POINT BREAK request.
11) Responsibility :
POINT BREAK cannot be held responsible for any inconvenience or damage emanating from the use of the internet network, such as a supply cut, computer virus or external intrusion or, more generally, any case qualified by the tribunals as "force majeure".
12) Dispute settlement :
In case of dispute, an amicable solution will be sought before entering any legal action. Otherwise, any legal action will be brought to the relevant tribunals (the geneva tribunals) within the juridiction of POINT BREAK S.N.C. head office. |
